Terms of Service

1. Acceptance of Terms

By accessing or using Anzol Guard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including business customers and their administrators.

2. Description of Service

Anzol Guard provides phishing simulation and security awareness training services to businesses. The Service sends simulated phishing emails to employees of our customers for the purpose of security education. All simulations are conducted with the explicit consent and authorisation of the employer.

3. Customer Responsibilities

By using the Service, you confirm that:
  • You have the legal authority to enter into this agreement on behalf of your organisation.
  • You have obtained any necessary internal authorisations to conduct phishing simulations on your employees.
  • You will inform employees that security testing may occur, consistent with your local employment laws.
  • You will not use the Service for any unlawful purpose or to target individuals outside your organisation.
  • You will keep your account credentials confidential and notify us immediately of any unauthorised access.

4. Acceptable Use

The Service may only be used for legitimate security awareness training within your organisation. You may not use the Service to conduct actual phishing attacks, to target individuals without authorisation, to distribute malware, or for any fraudulent or criminal purpose. We reserve the right to terminate accounts that violate this policy without notice.

5. Subscription and Payment

Access to the Service is provided on a subscription basis. Subscription fees are billed monthly or annually as selected at signup. All fees are exclusive of applicable taxes. We reserve the right to change pricing with 30 days written notice. Refunds are not provided for partial billing periods unless required by applicable law.

6. Data Processing

In providing the Service, we process personal data on your behalf as a data processor under GDPR. This includes employee email addresses and click behaviour data from simulations. Our processing is governed by our Privacy Policy and any Data Processing Agreement entered into with your organisation.

7. Intellectual Property

All content, templates, software, and materials provided through the Service are the property of Anzol Guard or its licensors. You may not reproduce, distribute, or create derivative works without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Anzol Guard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.

9. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion, unless you request earlier deletion or applicable law requires otherwise.

10. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

11. Changes to Terms

We may update these Terms from time to time. We will notify you by email or through the Service at least 14 days before changes take effect. Continued use of the Service after changes constitutes acceptance.
